It is currently zoned as Waste Management on Schedule A10 of the 2018 Chatham Kent Official Plan (OP). I would hope the re-establishment of an active waste management facility can be appealed based on the following:

1. The Property overlaps with Floodplain as identified on Schedule C10 on the OP.

2. Significant Woodland is identified directly adjacent to the Property on Schedule C10 on the OP.

3. Molly's Creek and a constructed drain are located directly East and West of the property, respectively.

4. Molly's Creek and the constructed drain provide habitat for Blackstripe Tapminnow, a Special Concern fish Species.

5. Molly's Creek and the constructed drain flow into the Sydenham River which provides habitat for 3 Endangered, 3 threatened, and 5 Special Concern fish species.

6. Molly's Creek and the constructed drain flow into the Sydenham River which provides habitat for 8 Endangered, 5 threatened, and 1 Special Concern Mussel species.

7. Molly's Creek and the constructed drain flow into the Sydenham River which provides habitat for 1, Endangered, 1 threatened, and 2 Special Concern Turtle species.

8. The Property overlaps with the habitat range of 1 Endangered and 1 threatened mammal species.

9. The Property overlaps with the habitat range of 4 Endangered, 12 Threatened, and 5 Special Concern bird species.

10. The Property overlaps with the habitat range of 4 Endangered, and 2 Threatened plant species.

11. The Property overlaps with the habitat range of 1 Endangered, and 1 Special Concern snake species.

12. The Property overlaps with the habitat range of 3 Endangered, and 1 Special Concern insect species.
