Pourquoi une consultation n’est pas nécessaire
On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.
Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on April 22, 2020 while Ontario Regulation 115/20 was in effect.
Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1678 for public comment from April 22, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument decision details
An amendment to Environmental Compliance Approval is granted to Pomas Farms Inc. for sewage works expansion (increase rated capacity from 40,000 L/day to 96,000 L/day) to service a new bunkhouse and two existing bunkhouses for accommodating a total of 320 on-site workers, other 144 employees at greenhouse and warehouse facilities, as well as 13 loading docks, located at 1057 Highway 77, in the Municipality of Leamington.
The remaining existing sewage works include Phases 1&2 sewage grease interceptor, septic tank and Waterloo Biofilter treatment unit as new pre-treatment measure, and Phases 3~5 grease interceptors, septic tanks and balancing tank.
The new works includes two grease interceptors, one (1) 60,000 L equalization tank/pump station PS1, one primary sedimentation tank comprised of four (4) tanks (retrofitted from existing Biofilter 31,800 L (each) tanks), two Moving Bed Biofilm Reactor (MBBR) reactors with chemical dosing system, one final clarifier, one roller cloth filer system, and one UV disinfection system. The final effluent will be discharged into West Branch of Reid Drain.

Effects of consultation
Third parties are not able to apply for leave to appeal in respect of proposals which are posted while Ontario Regulation 115/20 is in effect. On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak which exempts all proposals from the requirement to post notices on the ERO. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
