On October 31, 2022, we approved a new Environmental Compliance Approval (ECA) for for ReSoil Solutions Inc. for a waste disposal site (transfer/processing).

The ECA approves a new waste transfer/processing site for the receipt and transfer of non-hazardous waste limited to liquid soil generated from hydro-excavation drilling and daylighting activities in residential, industrial, commercial and institutional areas within Ontario.

The site will receive liquid soil via hydro-excavation trucks. All incoming liquid soil will be unloaded and processed indoors. Processing includes screening and dewatering of the liquid soil to generate process water and dewatered soil. The building has appropriate infrastructure (sump and dykes) to capture and contain the largest possible spill indoors. All dewatered soil and aggregate will be stored outdoors in three-sided bunkers which are covered and lined with impermeable liners and covers (tarps or any equivalent).

The site is approved to receive up to 375 cubic metres of liquid soil per day, with a maximum storage limit of 2,700 cubic metres of dewatered soil/aggregate, 94 cubic metres of process water, and 40 cubic metres of residual waste (plastic, litter, etc.).

The site is approved to operate 6:00 a.m. to 7:00 p.m., 7 days a week, unless restricted by municipal by-laws.

The information below summarizes the comment received and how we considered and addressed it as part of our decision:

  1. Concerns regarding the use not fully contained within enclosed buildings.

    Response: The conditions of the Environmental Compliance Approval require the owner to conduct all receiving and processing of waste indoors, with all dewatered soil stored outdoors in three-sided concrete bunkers which are lined and covered with an impermeable material (tarp or equivalent).

  2. Concerns regarding odour, dust, smoke, glare, noise, gas fumes, cinders, vibration, refuse matter, or water carried waste.

    Response: The conditions of the Environmental Compliance Approval require the owner to adhere to a dust management plan which includes wetting of roadways/stockpiles, on-site vehicle speed limits, and stockpile size and storage restrictions. Regarding noise, this concern is related to the air/noise Environmental Compliance Approval application and is out of scope of the waste disposal site Environmental Compliance Approval review process. Regarding water carried waste, the condition of the ECA required the owner to obtain a sewage works ECA and since this concern is related to the sewage works Environmental Compliance Approval application, it is out of scope of the waste disposal site ECA review process.

  3. Concerns regarding the municipal water or sewer supply.

    Response: Municipal water and sewer supply are under municipal jurisdiction which are out-of-scope of the Environmental Compliance Approval review process.

Seek leave to appeal

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

This proposal is for an Environmental Compliance Approval (waste disposal site) for a non-hazardous solid and liquid waste transfer and processing facility in Thornhill, Ontario.

The facility accepts, processes, and transfers non-hazardous liquified soil and slurry from hydrovac vehicles that service the Province of Ontario.

The maximum quantity of waste delivered to the site on any given day is 900 cubic metres of liquid waste and 400 tonnes of solid waste. The maximum storage capacity at any given time is 800 tonnes.

The facility operates from 6:00 a.m. to 7:00 p.m., Monday to Sunday.
