Please find attached detailed comments from the Town of The Blue Mountains. In summary the comments include the following:
1. Transition Provisions need to ensure that any Section 37 Planning Act payment requirements for on-going developments under existing agreements will carry forward in accordance with the agreement provisions and will not be eliminated by the transition provisions.
2. Exemptions from Community Benefits Charges could benefit other types of development that are considered important to a local municipality. Additional exemptions to the Community Benefits Charge for preferred development forms should be included as determined by a Municipal Council and outlined in the Community Benefits By-law.
3. Community Benefits Formula should include cash payment OR the opportunity for a developer to provide the community benefit directly into their project (or nearby) at a value greater or equal to the payment amount.
4. The process (and timing) to receive Appraisals for Community Benefits appear late in the project approvals process. The Town supports the appraisal valuation based on the inclusion of develpoment permissions granted, however the timing to receive and review would appear to add significant time to the project approval on an already tight timeline.
