Notice Period

LRT:

The changes should not result in implications to the City

Parts II (Corridor Control) and V (Municipal Service and Right of Way Access)

Concerns:

LRT:

Metrolinx review and Corridor Development Permits (CDP) will continue as requirements post-LRT construction, into operation and maintenance

HSR:

Expanding to operations and maintenance means introducing an entirely separate regulatory process across Ontario’s major cities in perpetuity (theoretically), with some of the transit projects likely to be operated and maintained by private companies. Why should residents and businesses who choose to locate near transit service be penalized with a regime to use their property that has less notice and les rights for them than a similar business further away? Construction is (in theory) a limited time period; operations and maintenance, while often signed in 20/30 year terms, continues.

Clarity required on the following:

HSR:

How will this interact with road standards and bike lanes? It appears this sets up the Province to be able to demolish and rebuild municipal infrastructure to new standards that may not reflect the needs or will of the local population as desired. How will existing projects be delivered, which have often taken in municipal standards with the goal of replacing like for like.

Part V

Clarity required on the following:

LRT:

Unclear if these additions will be funded by the Minister

Additional Municipal Infrastructure

Clarity required on the following:

HSR:

If replacing other infrastructure, what will the timelines be for the replaced infrastructure?

Will they be built to the same standards/lifecycles as budgeted for by the municipality, or to a new standard set by the Province?

LRT:

The orders can be related to the design of municipal infrastructure as part of the LRT project
