Re: Transfer of Land Title from Wasaga Beach Provincial Park to the Town of Wasaga Beach
I am writing to suggest there may be a need for some caution in respect to legality in the transfer of the lands under discussion.
We acquired this information as part of a legal opinion while pursuing another, unrelated matter.
The source references specifically Ontario Regulation 451/74 under the Provincial Parks Act and states,
"Land for provincial parks can be acquired by grant or expropriation."
The boundaries of Wasaga Beach Provincial Park were established through an Order in Council which does not provide for expropriation and, by definition, was not a grant.
The caution, to the best of our knowledge, may apply to ownership of beach front.
It may be worthwhile to ensure title to beachfront was properly assumed when the properties entered into the public realm.
Indeed, and as an aside, this is a question across much of the beachfront currently claimed by Wasaga Beach Provincial Park and fronting private property.
